The Legislation of the Palestinian president's Decision  Regarding the Referendum Document of prisoners

          The study displayed a legal study regarding the constitutionality of the Palestinian president's decision to perform a referendum for prisoners document. The case in Palestine seems that the public don't have any authority to accept or refuse any decisions; they just participate in the parliamentary election. Consequently,  after the election process the public don't direct any kind of authority since the elected candidates will practice their authority in represent of them.

they don't have any authority to  refuse the laws adopting in the parliamentary council. They also don't have the rights to eliminate any member of the lower house; accordingly, due to the aforementioned, any referendum in Palestine is considered against laws.

As the result, due to the above mentioned,  The referendum decision which is displayed in the presidency electronic site is considered

  1. Unconstitutional and doesn't belong to any legislation or legal article.

  2. This decision and its consequences  don't contain any legal and/or constitutional value and/or any obligatory word for the legislative council to adopt it.

  3. This decision indicate to the misuse of authority. it violates the laws and the legislations.

  4. The site of the presidency could perform a draft of the referendum document to the legislative council. Then the Parliament  has the right to adopt it or not.

  5. The laws don't include any article regarding the jurisdiction to perform the referendum document.
